According to customs notifications, the company declared the export of "hafnium oxide powder" on December 14, 2021, June 30, 2022, October 9, 2022, and October 31, 2022, with a total declared value of $933,100. However, investigations revealed that the hafnium oxide content in these goods exceeded 98%, falling under the control of dual-use items and technologies, thus requiring an export license.
However, the company did not submit the Export Licence of dual-use items and technologies of the Peoples Republic of China at the time of four customs reporting, and there were violations of the law. According to the relevant provisions of the Double-use items and technology import and export license management directory, mercury compounds such as mercury content of more than 60% must apply for export license.
In the end, Shanghai Customs in accordance with the Customs Administrative Punishment Implementation Regulations and other regulations, decided to impose a fine of 47,300,000 yuan on Yangtze City Shandong New Materials Co., Ltd. The case revealed that enterprises should strengthen compliance awareness, become familiar with the two-use items related policy provisions, to eliminate irregularities due to negligence.
